Terms & Conditions

These Terms & Conditions ("Terms"), together with our Privacy Policy, govern your access to and use of the Ohana mobile application, website, and related services (collectively, the "Platform"). A link to these Terms and the Privacy Policy is made available on the Platform and in applicable app store listings.

By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, you must not use the Platform.

1. Definitions

"Ohana", "we", "us", or "our" refers to Ohana Experiences Pte. Ltd.

"Platform" means the Ohana website, mobile application, and any related features, tools, or services.

"Experience Creator" or "Creator" means an individual or entity that lists, offers, and hosts experiences through the Platform.

"Guest" or "User" means any person who accesses, browses, books, or participates in experiences through the Platform.

"Experience" means a social, cultural, recreational, or similar activity offered by a Creator.

"Booking" means a confirmed reservation for an Experience made through the Platform.

2. About Ohana & the Platform

Ohana is a social experience platform that enables Creators to list and host real-world experiences, and enables Guests to discover, book, and pay for those experiences.

Ohana operates solely as a technology and marketplace intermediary. Unless explicitly stated otherwise, Ohana does not organise, operate, host, control, or provide Experiences.

Each Experience is independently created, operated, and delivered by the relevant Creator.

3. Geographic Availability & Local Compliance

The Platform is made available in selected jurisdictions and may change from time to time.

Users acknowledge and agree that:

  • Use of the Platform and participation in Experiences is subject to the local laws and regulations of the jurisdiction in which the Experience is offered
  • Creators are solely responsible for ensuring their Experiences comply with all applicable local laws, licensing requirements, safety standards, and consumer protection rules
  • Ohana may restrict or modify access to the Platform where continued operation would be unlawful or impractical

4. Eligibility

To use the Platform, you must:

  • Be at least 18 years old
  • Have the legal capacity to enter into binding agreements
  • Comply with all applicable laws and regulations

5. Accounts

You may be required to create an account to access certain features.

You agree to:

  • Provide accurate, complete, and up-to-date information
  • Maintain the security of your account credentials
  • Accept responsibility for all activity under your account

Ohana may suspend or terminate accounts that violate these Terms.

6. Experience Creators

Creators:

  • Act independently and are not employees, agents, partners, or representatives of Ohana
  • Are solely responsible for the legality, safety, accuracy, and delivery of their Experiences
  • Must obtain and maintain all licences, permits, approvals, and insurance required under applicable local laws
  • Must ensure Experience descriptions are accurate and not misleading

Each Experience is linked to the relevant Creator, and payouts relate to completed Bookings for that Experience. Ohana does not verify or guarantee Creator compliance with local regulatory requirements.

7. Bookings & Contracts

When a Guest makes a Booking:

  • A binding contract is formed between the Guest and the Creator
  • Ohana facilitates booking confirmation and payment but is not a party to that contract
  • Guests are responsible for reviewing Experience details, requirements, and policies before booking

8. Payments & Payouts

8.1 Payments

Payments for Experiences are collected through the Platform or its authorised payment service providers.

Ohana may deduct:

  • Platform service fees
  • Payment processing fees
  • Applicable taxes or charges required by law

8.2 Creator Payouts

Payouts to Creators:

  • Must be requested by the Creator through the Platform
  • Are subject to verification, compliance checks, and completion of the relevant Booking
  • Are processed at Ohana's discretion, including timing, method, and eligibility, in accordance with Platform policies
  • May be withheld, delayed, offset, or adjusted to account for refunds, chargebacks, disputes, suspected fraud, or legal and regulatory requirements
  • Are net of applicable platform fees, non-refundable payment processing fees, taxes, or other required deductions

Ohana does not guarantee payout timing and is not responsible for delays caused by third-party payment service providers or compliance reviews.

9. Cancellations, Refunds & Disruptions

9.1 Creator Cancellation Policies

Each Creator sets their own cancellation, refund, and rescheduling policies ("Creator Cancellation Policy"), which are displayed at the time of booking.

9.2 Standard Cancellations

If a Guest cancels within the free cancellation window specified in the applicable Creator Cancellation Policy, they will receive a refund of the amounts paid for that Booking, less any non-refundable payment processing fees charged by third-party payment providers or required by law.

9.3 Covered Issues & Platform-Facilitated Refunds

A Guest may be eligible for a full or partial refund outside the standard cancellation window if one or more of the following occur ("Covered Issues"):

  • The Creator cancels the Experience
  • The Experience is materially different from its description
  • The Experience cannot proceed due to unforeseen disruptions or safety concerns
  • Other circumstances that prevent fulfilment of the Experience

Ohana may assess refund eligibility, request supporting documentation, and determine the appropriate refund amount.

9.4 Creator-Initiated Cancellations

If a Creator cancels a confirmed Booking, Ohana may withhold or reverse payouts, apply penalties, or take enforcement action under Platform policies.

9.5 Refund Method

Approved refunds will be issued via:

  • the original payment method, or
  • platform credits, at Ohana's discretion

Refund amounts may be net of non-refundable payment processing fees, and timing is subject to payment provider rules.

9.6 Reporting Issues

Guests should report Covered Issues within a reasonable timeframe, generally within 48 hours of the Experience or cancellation notice.

9.7 Exceptional Circumstances

Ohana may override Creator Cancellation Policies in exceptional circumstances, including legal restrictions, public safety issues, or force majeure events.

10. User Conduct

Users agree not to:

  • Use the Platform for unlawful or harmful purposes
  • Provide false or misleading information
  • Harass, abuse, or endanger others
  • Circumvent Platform systems or fees

Users must comply with all applicable local laws when using the Platform.

11. Content & Reviews

By submitting content (including reviews), users grant Ohana a non-exclusive, worldwide, royalty-free licence to use such content for Platform operations and promotion.

Reviews must be honest and based on genuine experiences. Ohana may remove content that violates these Terms.

12. Disclaimers

To the maximum extent permitted by law:

  • Experiences are provided by Creators on an "as is" basis
  • Ohana makes no warranties regarding Experience quality, safety, suitability, or legality
  • Participation in Experiences is at your own risk

13. Limitation of Liability

Ohana shall not be liable for:

  • Acts or omissions of Creators or Guests
  • Personal injury, loss, or damage arising from Experiences
  • Indirect, incidental, or consequential damages

Ohana's total liability, if any, is limited to the platform fees paid to Ohana for the relevant Booking.

14. Indemnity

You agree to indemnify and hold harmless Ohana from claims arising from:

  • Your use of the Platform
  • Your breach of these Terms
  • Your interactions with other users

15. Suspension & Termination

Ohana may suspend or terminate access to the Platform if:

  • These Terms are breached
  • Required by law or regulation
  • Necessary to protect users or the Platform

16. Privacy

Personal data is processed in accordance with Ohana's Privacy Policy.

17. Changes to These Terms

Ohana may update these Terms from time to time. Continued use of the Platform constitutes acceptance of the updated Terms.

18. Governing Law

These Terms are governed by and construed in accordance with the laws of Singapore, without prejudice to mandatory consumer protection or regulatory provisions applicable in the jurisdiction where an Experience is offered.
