These Terms & Conditions ("Terms"), together with our Privacy Policy, govern your access to and use of the Ohana mobile application, website, and related services (collectively, the "Platform"). A link to these Terms and the Privacy Policy is made available on the Platform and in applicable app store listings.
By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, you must not use the Platform.
"Ohana", "we", "us", or "our" refers to Ohana Experiences Pte. Ltd.
"Platform" means the Ohana website, mobile application, and any related features, tools, or services.
"Experience Creator" or "Creator" means an individual or entity that lists, offers, and hosts experiences through the Platform.
"Guest" or "User" means any person who accesses, browses, books, or participates in experiences through the Platform.
"Experience" means a social, cultural, recreational, or similar activity offered by a Creator.
"Booking" means a confirmed reservation for an Experience made through the Platform.
Ohana is a social experience platform that enables Creators to list and host real-world experiences, and enables Guests to discover, book, and pay for those experiences.
Ohana operates solely as a technology and marketplace intermediary. Unless explicitly stated otherwise, Ohana does not organise, operate, host, control, or provide Experiences.
Each Experience is independently created, operated, and delivered by the relevant Creator.
The Platform is made available in selected jurisdictions and may change from time to time.

Ohana may suspend or terminate accounts that violate these Terms.
Creators:
Each Experience is linked to the relevant Creator, and payouts relate to completed Bookings for that Experience. Ohana does not verify or guarantee Creator compliance with local regulatory requirements.
When a Guest makes a Booking:
Payments for Experiences are collected through the Platform or its authorised payment service providers.

Ohana does not guarantee payout timing and is not responsible for delays caused by third-party payment service providers or compliance reviews.
Each Creator sets their own cancellation, refund, and rescheduling policies ("Creator Cancellation Policy"), which are displayed at the time of booking.
If a Guest cancels within the free cancellation window specified in the applicable Creator Cancellation Policy, they will receive a refund of the amounts paid for that Booking, less any non-refundable payment processing fees charged by third-party payment providers or required by law.
A Guest may be eligible for a full or partial refund outside the standard cancellation window if one or more of the following occur ("Covered Issues"):
Ohana may assess refund eligibility, request supporting documentation, and determine the appropriate refund amount.
If a Creator cancels a confirmed Booking, Ohana may withhold or reverse payouts, apply penalties, or take enforcement action under Platform policies.

Refund amounts may be net of non-refundable payment processing fees, and timing is subject to payment provider rules.
Guests should report Covered Issues within a reasonable timeframe, generally within 48 hours of the Experience or cancellation notice.
Ohana may override Creator Cancellation Policies in exceptional circumstances, including legal restrictions, public safety issues, or force majeure events.
Users agree not to:
Users must comply with all applicable local laws when using the Platform.
By submitting content (including reviews), users grant Ohana a non-exclusive, worldwide, royalty-free licence to use such content for Platform operations and promotion.
Reviews must be honest and based on genuine experiences. Ohana may remove content that violates these Terms.
To the maximum extent permitted by law:

Ohana's total liability, if any, is limited to the platform fees paid to Ohana for the relevant Booking.
You agree to indemnify and hold harmless Ohana from claims arising from:
Ohana may suspend or terminate access to the Platform if:
Personal data is processed in accordance with Ohana's Privacy Policy.
Ohana may update these Terms from time to time. Continued use of the Platform constitutes acceptance of the updated Terms.
These Terms are governed by and construed in accordance with the laws of Singapore, without prejudice to mandatory consumer protection or regulatory provisions applicable in the jurisdiction where an Experience is offered.
