This Privacy Policy explains how Ohana Experiences Pte. Ltd. ("Ohana", "we", "us", or "our") collects, uses, discloses, and protects personal data when you access or use the Ohana mobile application, website, and related services (collectively, the "Platform"). This Privacy Policy should be read together with our Terms & Conditions, which govern your use of the Platform.

1. Scope & Applicability

This Privacy Policy applies to Guests who browse, book, or participate in experiences, Experience Creators who list or host experiences, and visitors to our website or app. By using the Platform, you acknowledge that your personal data will be processed as described in this Privacy Policy.

2. Personal Data We Collect

We may collect the following categories of personal data. Information you provide directly may include your full name, email address, phone number, profile information such as photos or biography, messages between Guests and Creators, booking details and preferences, support requests and communications, and identity or verification information where required for compliance or payouts.

Payment and transaction data may include booking amounts and transaction history, payout details for Creators, and partial payment information processed securely by payment service providers. Ohana does not store full credit card or payment card numbers; payment data is handled directly by third-party payment service providers.

Automatically collected information may include device and app information such as device type, operating system, and app version, IP address and approximate location, usage data and interaction logs, and cookies or similar technologies on the website.

We may also receive information from third parties such as identity or compliance information from verification providers, payment confirmations from payment service providers, and analytics and performance data from service providers.

3. How We Use Personal Data

We use personal data to provide, operate, and maintain the Platform; facilitate bookings, payments, refunds, and payouts; verify identity, prevent fraud, and ensure platform integrity; communicate with users regarding bookings, updates, and support; improve and optimise the Platform; comply with legal, regulatory, and tax obligations; and enforce our Terms & Conditions and Platform policies.

4. Legal Bases for Processing

We process personal data based on one or more of the following legal bases, as applicable: performance of a contract such as facilitating bookings and payouts; legitimate business interests; compliance with legal or regulatory obligations; and user consent, where required under applicable law, including Thai personal data protection laws.

5. Sharing & Disclosure of Personal Data

We may share personal data with Experience Creators and Guests, where booking-related information is required to enable the Experience. We may also share personal data with service providers, including payment service providers, cloud hosting and infrastructure providers, analytics and monitoring services, customer support tools, and identity verification and compliance providers, who process data on our behalf subject to confidentiality and data protection obligations.

Personal data may be disclosed to legal or regulatory authorities where required by law, regulation, court order, or to protect rights, safety, or prevent fraud. Personal data may also be shared in connection with a merger, acquisition, restructuring, or sale of assets, subject to applicable data protection laws.

6. International Data Transfers

Personal data may be transferred to and processed in jurisdictions outside the country in which you are located. Where such transfers occur, we take reasonable steps to ensure appropriate safeguards are in place in accordance with applicable data protection laws, including contractual and organisational safeguards, and in line with the Singapore PDPA and Thailand PDPA.
